1. Who We Are
NOVELTY ("the Service") is a subscription sports-analysis product operated by Locust Harvest (Pty) Ltd ("we", "us", "the Company"), providing daily statistical picks and analysis for football/soccer.
2. The Service
Subscribers get access to a daily "Top 20" ranked list of picks, generated by statistical analysis of odds and outcome probabilities. Free users see a limited preview; subscribers see the full list with analysis. We may change, suspend, or discontinue any part of the Service.
3. Subscription & Billing
- Price: R99/month, billed in advance via PayFast.
- Auto-renews monthly unless cancelled; advance notice before fixed-term renewal, per the Consumer Protection Act. Cancel anytime, effective end of current billing period. 5-business-day cooling-off for marketing-channel signups. No fixed term exceeds 24 months without your explicit agreement for your financial benefit.
4. Informational Only — No Betting Facilitated
NOVELTY provides sports statistics, analysis, and predictions for informational and entertainment purposes only. We do not accept bets, wagers, or stakes of any kind, do not hold or transmit betting funds, and are not a bookmaker. Any betting you choose to do is through third-party, independently licensed operators of your own choosing, entirely outside this Service.
5. No Guaranteed Outcomes
Sports outcomes are inherently uncertain. Past performance of our picks doesn't guarantee future results. We make no warranty about the accuracy or profitability of any pick, rating, or analysis provided.
6. Age & Responsible Use
Gamble Responsibly. The Service is intended for users 18 years and older only; age is verified at signup. If you or someone you know shows signs of a gambling problem, the South African Responsible Gambling Foundation helpline (0800 006 008, responsiblegambling.co.za) offers free, confidential support.
7. On Licensing
NOVELTY is structured to be an information/prediction/subscription platform, not a bookmaker: it analyses fixtures, generates predictions, displays odds and implied probabilities, and ranks selections for a monthly subscription fee — it does not accept wagers, collect stakes, determine or pay gambling winnings, maintain betting accounts, or act as anyone's bookmaker. The National Gambling Board's own position is that online betting is legal when conducted through a provincially-licensed bookmaker; NOVELTY isn't conducting betting at all under that framing. This position is researched but has not yet been confirmed by a formal written legal opinion from a South African gambling-law specialist.
7a. Gambling Advertising Compliance
Separately from the licensing question, the NGB has issued specific guidance on gambling-advertising compliance under the National Gambling Act and provincial legislation. NOVELTY's marketing describes what it actually sells — analysis, predictions, statistical picks — and avoids language that reads as encouraging wagering (e.g. avoiding phrases like "place your bet" or "value bets" in favour of "statistical picks"/"predictions").
8. Your Account
You're responsible for your login credentials and account activity.
9. Acceptable Use
No unlawful use, redistribution of picks/analysis for commercial resale, or interference with the Service.
10. Limitation of Liability
Not liable for indirect, incidental, or consequential damages, including any financial loss from betting decisions you make based on our content — see §4 and §5.
11. Termination
We may suspend/terminate accounts for breach, non-payment, unlawful use, or misuse (e.g. commercial redistribution of picks).
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa; disputes fall under South African court jurisdiction.
Privacy Policy
Information We Collect
- Account data — name, email, and other signup details.
- Age-verification data — your date of birth, collected and checked at signup to confirm you're 18 or older; this is a legal requirement for this Service, not optional.
- Payment data — your subscription payment is processed by PayFast, a licensed South African payment gateway; we don't store your card details.
- Usage data — which picks you view, standard technical/device data.
How We Use It
- To verify you meet the 18+ age requirement before granting access.
- To process your subscription payment via PayFast.
- To generate and rank the daily picks you see, using data purchased from a third-party sports-odds data provider (the-odds-api.com) — this is data we license to build our own analysis, not a sharing of your personal data with that provider.
Third Parties
We share data with PayFast (payment processing) only. We separately purchase odds/fixture data from the-odds-api.com to generate our picks — this is data we consume to build the Service, not a transfer of your personal information to that provider.
Your Rights (POPIA)
You have the right to: be notified of what we collect and why; access your own information; request correction or deletion; object to processing; opt out of direct marketing; protection from decisions based solely on automated processing; and the right to complain to the Information Regulator or pursue civil action. Data Retention
We retain account and age-verification data for as long as your account is active, and for a reasonable period afterward to meet legal, accounting, and age-verification recordkeeping needs.
Security
We apply reasonable technical and organisational safeguards to protect your information, including restricting access to age-verification data to what's needed to meet our legal obligation to exclude under-18 users.
